Terms of Service
These Terms of Service ("Terms") form a binding agreement between you and Marco Polo Research Lab LLC, a California limited liability company ("MPR Lab", "Company", "we", "our", "us"), for access to and use of SummerCan (the "Service"). By using the Service, you agree to these Terms.
1. Eligibility and Account Use
- You must be legally able to enter into contracts to use the Service.
- If you provide information about a child, you represent that you are authorized to do so.
- You are responsible for activity under the account and devices used to access SummerCan.
2. Service Description
SummerCan helps families discover camp sessions, save planning preferences, compare schedules, and generate shareable planning outputs. Features, source coverage, and product behavior may change over time.
3. Shared Plans and Account Security
SummerCan may provide share links for completed plans. Anyone with a valid share link may be able to view that shared plan, so you are responsible for deciding when and with whom to share those links.
4. Acceptable Use
- Use the Service only for lawful purposes.
- Do not attempt unauthorized access, interfere with service availability, or abuse automated discovery features.
- Do not submit unlawful, infringing, abusive, or malicious content or data.
5. Camp Data and Planning Output
SummerCan assembles planning information from public camp-provider sources and from the inputs you supply. Camp availability, dates, pricing, enrollment rules, and provider policies may change without notice, and you are responsible for verifying important details with the actual camp provider before relying on them.
SummerCan does not provide childcare, medical, educational, or legal advice, and it does not guarantee admission, placement, or camp-provider performance.
6. User Data and Limited License
You retain rights to the information you submit. You grant us a limited license to store, process, display, and transmit that information as needed to provide, secure, and improve the Service.
7. Optional Schedule Emails
If schedule-email delivery is enabled in your environment, you may use the result page to send the final-plan link to your account email on demand. Delivery may be delayed or unavailable due to provider outages, configuration issues, or account settings outside our control.
8. Future Paid Features
SummerCan may introduce paid or premium features in the future. If that happens, pricing, checkout, billing, refund, and merchant-of-record terms will be disclosed at the time of purchase or through updated terms.
9. Third-Party Services
The Service depends on third-party services such as authentication providers, hosting, infrastructure tooling, and email delivery providers. We are not responsible for downtime or acts of third parties beyond our contractual obligations to you.
10. Availability and Changes
We may update, suspend, or discontinue features at any time, including to improve security, comply with legal obligations, or maintain platform integrity.
11. Suspension and Termination
We may suspend or terminate access if you violate these Terms, create legal or security risk, or misuse the Service. You may stop using the Service at any time.
12. Intellectual Property
The Service software, design, branding, and related materials are proprietary to Marco Polo Research Lab LLC and its licensors and are protected by applicable intellectual property laws.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted availability, error-free operation, or that SummerCan outputs will satisfy any specific scheduling, enrollment, or family-planning outcome.
14. Limitation of Liability
To the maximum extent permitted by law, Marco Polo Research Lab LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunity arising from use of the Service.
